Terms of Service

These terms govern your use of Lavender Atlas (lavenderatlas.com), operated by Lavender Atlas ("we," "us," or "our"). By using the site, you agree to these terms. If you do not agree, do not use the site.

1. What Lavender Atlas is

Lavender Atlas is an online directory of gay-friendly and gay-owned travel venues and events, provided for general informational purposes. Browsing is free. We also offer paid business listing features, described below.

2. Who can use it

You must be at least 18 years old to use the site. Some venues and content listed are intended for adults. You are responsible for following the laws that apply to you.

3. Listings and information

Listings are compiled from public sources, business submissions, and user reports. We do not own or operate the venues listed, and we do not guarantee their accuracy, availability, or quality. Always verify details directly with the venue. Our Disclaimer is part of these terms.

4. Business listings and claims (paid)

Businesses can claim a listing and subscribe to paid tiers (currently Basic, Standard, and Featured). Paid features may include editing your own information, additional photos, priority placement, and analytics, as described at checkout.

  • You may only claim a listing you are authorized to represent.
  • You are responsible for the accuracy of the information you add, and for having the rights to any content and images you upload.
  • We may review, edit, reject, suspend, or remove any listing or claim at our discretion, including for inaccurate, unlawful, or abusive content.
  • Billing and cancellation for paid listings are covered in our Refund Policy.

5. Submissions and reports

When you submit or report a listing, or send us content, you grant us a non-exclusive, worldwide, royalty-free license to use, edit, display, and distribute that content on the site and in related materials (for example, the newsletter). You confirm you have the right to share it. We are not obligated to publish or keep any submission, and we may moderate or remove content at our discretion.

6. Acceptable use

Do not misuse the site, scrape or bulk-copy the data, attempt to disrupt or gain unauthorized access, submit false or infringing content, or use the site to harass others or break the law.

7. Payments

Paid listings are billed through our payment processor (Stripe). By subscribing, you authorize recurring charges (monthly or annual, as selected) until you cancel. Prices are shown at checkout and may change with notice for future billing periods. You are responsible for any applicable taxes. Refunds and cancellation are governed by our Refund Policy.

8. Affiliate links

Some links on the site are affiliate links. If you book or buy through them, we may earn a commission at no extra cost to you. This does not affect whether or how a venue is listed.

9. Intellectual property

The Lavender Atlas name, logo, site design, written content, and the compiled directory are owned by us and protected by law. You may not copy, resell, or republish substantial portions of the directory without permission. Business names, logos, and trademarks belong to their respective owners.

10. Disclaimers

The site is provided "as is" and "as available," without warranties of any kind, to the maximum extent permitted by law. We do not warrant that the site will be uninterrupted, error-free, or accurate. See our Disclaimer for details on listing accuracy and third-party content.

11. Limitation of liability

To the maximum extent permitted by law, Lavender Atlas is not liable for any indirect, incidental, or consequential damages, or for losses, incidents, or injuries arising from your use of the site, reliance on listing information, or interactions with listed businesses or events. Our total liability for any claim related to these terms or your use of the site is limited to the amount you paid us in the 12 months before the claim arose.

12. Indemnification

You agree to indemnify and hold Lavender Atlas harmless from claims arising out of your content, your use of the site, or your violation of these terms.

13. Dispute resolution and arbitration

Any dispute arising out of or relating to these terms or your use of the site will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, conducted in Sacramento, California. You waive any right to a jury trial and any right to bring or participate in a class action. Either party may seek injunctive or other equitable relief in court for claims involving intellectual property or unauthorized access.

14. Governing law

These terms are governed by the laws of the State of California, without regard to its conflict-of-law rules.

15. Changes to these terms

We may update these terms. We will change the effective date above, and significant changes will be posted on this page. Continued use after changes means you accept the updated terms.
